Breeder won't honor contract.

I need help.

I purchased a female F2 3 years ago to start a breeding program in my area. Unfortunately, the cat had a very rare disease (poor girl) called pemphigus. She had symptoms already when we got her that looked like ear mites but the symptoms got worst and worst, crust on her nose and ears, she looked like a mess. The vets did all the testings and ruled everything out until it was clear that it was pemphigus.

So I told the breeder in question (I will hold the name for now) and got a pretty positive response at first. After alot of e-mails back and forth, with pictures for proof and vet comments, we agreed that "they" would send me another cat in replacement and I would keep the first one because of her expenses and stress that would be harmfull if i sent her back. A contract was written, sent to me signed by "them". Now all I had to do was wait for the new cat right? Wrong! All of a sudden, their stance on the situation changed... They wanted vets receipts, a specialist report. They called me a con artist and said I was trying to screw them over.

Now, before all of you go "Duh.. of course you need to send a report from a specialist", you need to understand that everything was agreed upon before and I had a contract in hand for a new cat. Then I told him I would send him a report but you dont find skin specialist for animals at every corner around here. It seemed to be too late for "them" now and I wasnt getting another cat. Now he was blaming my other cats for giving her the disease (not contageous) and it all became a big circus act.

SO! Now, I am stuck -8000$ + in the hole with no new cat in sight. I live in Canada and the cat is from the US. How can I get them to honor their contract. Do I contact TICA, do I sue them?

Any advices would be appreciated.

I am sorry to hear that... Nice looking kitty, sorry that you are having these issues.. I wish you the best of luck with this, and welcome to the Forums... There are a lot of experts around here (I am certainly not one of them).

Well, you're girl is beautiful and you should be able to keep her...I am sorry you are having these issues.

So if you have a signed contract for the replacement cat, you should be able to sue them, although that may be difficult, depending where you are in Canada and where the breeder is located...TICA does not usually get involved in breeder disputes...I believe you are in the NE region of TICA, so may be able to contact the NE TICA Regional director for some assistance...what region is the breeder in? Do you know?

I bought my cat from Paul Beeson at AAA Savannah. He just contacted me agasin and now he wants to talk... He has given me the worst excuses in the book, threatened me, said he was going out of business and didnt care if I sued him. I feel he is making me run around in circles...

By looking at his website, he does not look like he is going out of business... They are advertised out of Winston-Salem, but in reality out of Pilot Mountain... I checked them on the BBB and they score only a "B" Rating (not really good)... You can check them out at: http://www.bbb.org/northwestern-nor.../aaa-savannahs-in-pilot-mountain-nc-235956123

It does list that they have had 1 complaint with the BBB that was resolved. You may be able to file a BBB. Remember that they are listed out of the Winston-Salem, NC office.

Oh WOW...your poor baby. That skin condition looks terrible. Is it painful? I sure hope not.

It IS standard and customary for a Breeder to request veterinary reports prior to offering a replacement, so this i NOT unusual in any way... It appears in this situation that the "veterinary proof" should have been requested by your Breeder and submitted by you or your vet long before any contract was issued for replacement.


I am personally not familiar with the disease that your cat suffers from and therefore would have wanted to chat with your vet personally to better understand the situation...not only out of concern, but also so that I could be educated as to whether or not the condition is heritable and could have effect on my other cats (or not).

Are you absolutely certain that your Breeder fully understands the diagnosis and has proof that replacement is due under the terms of the contract.

As I do not know your breeder, I cannot speak regarding whether or not he/she is truly shirking responsibility or not. Most reputable Breeders are quite reasonable once the case has been explained and veterinary records provided to support the diagnosis.

I hope that this is a case of misunderstanding and not the unwillingness to assume responsibility. Sadly, if the latter is true, you will be forced to resolve the matter through the court system, as TICA does not function as a policing organization at all, but rather is our REGISTRY.

I hope things work out of you...and am truly sorry that your foray into Breeding was wrought with such awful complications.

HOLY CRAP! I haven't heard Paul Beeson's name for a number of years now... Didn't even know he was still breeding, quite frankly. I just visited his website and was beyond stunned to see that on the list of SOLD cats in his Kittens Available area is an F2B PET MALE who he sold for $10,000! That hardly fits the profile of someone who is closing his doors... Anyone go the skinny on that? Now I'm just plain curious!

The main issue that seems to crop up here is the breeder takes a deposit and then drops off the face of the earth-- don't know how accurate that is, but it's what's been reported on this site repeatedly.

I'm so sorry about your baby-- that just looks horrid :(

Thanks all for the replies! Sad I did not know about this place earlier...

Yeah, pemphigus is basicaly the immune system that is attacking itself... I have a dedicated nurse and specialist taking care of her. I'm so lucky I found them for Zelda, I was getting desperate and was feeling so sad for her because she is the sweetest cat ever and she is so georgous.

Well, it's very weird that he came around all of a sudden... maybe he reads this forum. :)
