If you can not trace the serval in the pedigree can they still call it hybrid?

If it is called a Savannah (or Bengal, or Chausie, or Safari) it is still considered a hybrid, in those states that outlaw such hybrids. In states that specify generation such as NY then obviously if there is no serval in the immediate five generation pedigree then they consider the cat legal.

Here is the response I received today from the Nebraska Game and Parks Commission:

In looking up the Latin name for the savannah cat it is felis catus x leptailurus serval and thus would not be felis domesticus. I understand what your vet has stated, however there is no exception for that in this statute, as it has banned ANY member of the family Felidae, and then makes an exception for felis domesticus, only. This would also apply to the bengals, chausies, etc. Wolf hybrids are an entirely different situation as the entire canine family is not prohibited, so their hybrids are not prohibited. Nebraska is a state like Rhode Island...adamant about never allowing savannah cats...and the thing is, if you do get a Savannah cat and something happens, they WILL confiscate the cat...always remember, it is the cat that suffers in those cases, Please.

How absolutely ludicrous that wolf hybrids are legal and savannahs are not. What is the worst that can happen with a savannah? You get scratched or bit. What is the worst that can happen with a wolf? You die. So freaking backwards

Canine depend on being man's best friend and serving protecting their premises.
Feline can and will be self sufficient with the master serving the cat.
