I hear no formal complaint. I hear no evidence. All I hear is suppositions and allegations.
What I do hear is a bunch of cat house lawyers looking for business.

Your Honor... I would like to ask for an immediate dismissal of all charges.. Based on the fact that there is no evidence to support the client ever performed those tasks. There are no eye witnesses, and based entirely on accusations and assumptions. I would like to point out some cases in recent history that could account for this:

Police: Intruder caught cooking corn in home http://hosted.ap.org/dynamic/stories/U/US_COOKING_INTRUDER?SITE=AP&SECTION=HOME&TEMPLATE=DEFAULT

Cops photograph alleged sleeping Florida burglar http://hosted.ap.org/dynamic/stories/U/US_ODD_SLEEPING_BURGLAR?SITE=AP&SECTION=HOME&TEMPLATE=DEFAULT

Police: Man broke into bar, took nap in kitchen http://hosted.ap.org/dynamic/storie...ME&TEMPLATE=DEFAULT&CTIME=2014-09-09-09-51-25

It is the opinion of the Defense that a similar event happened here and the sleepy prosecution casting allegations elected not to see the real thief who just dropped by to check things out

Please note the accusation:

And then admitted that there are no eye witnesses.

Not so fast, counselor.
The kitty is known to inhabit the domicile at the pleasure of the owner / servant. There is no evidence presented of forcible entry. All three of your "examples" are the result of police investigation. It seems all I am hearing at this point is conjectured alternate theories. As of this point the plaintiff has circumstantial evidence.

I must ask the Judge to reconsider this... The only reason the police investigated the above mentioned is that the owners when they heard the noise that they investigated. The complainant in this case, heard the noises from the burglar and chose to ignore it and went back to sleep. If she had gotten up to investigate the police may have been there to investigate.

Well there you have it. The complainant, by your admission, chose to ignore it and went back to sleep. So there is no case. Dismissal without prejudice.
However, seeing that you knew this in advance, and still choose to waste this court's time, you are to serve 1 week in a hostel environment.;)
