The standard of proof is beyond a reasonable doubt, not beyond a shadow of a doubt. In this case I think someone needs to prove their innocence as with a savannah, there isn't much sunshine between between being the probable culprit and guilty.

And what about priors? Huh?
I witnessed the pool savandalism in person and posted photographic evidence. She was seen coveting the tree. She cased the joint. She has a known record at this residence. No need for a perp walk. I know who did this. The savandalism all started after she took up residence. How much smoke do you need to recognize a fire?

There is only a picture of a fallen over Christmas Tree and a suspect laying peacefully on the couch... Watching the scenery outdoors.. The picture only proves the tree fell over, not who did it...
